07.35am – The weather is turning for the worse, but then it must be expected as it is winter. This year it will be ten years that my father departed this earth and can I say I have never missed him so much as of late. You see as I am an only child and have not seen my family for over 1300 days, I know that had my father been alive, even at what would have been his 90 years, he would have been to see me and not judge me adversely. Do not misunderstand I can do a billion years alone, as I am well trained for such, but even at 61 years of age I have to say I really miss my father, but I do feel his presence now and again which makes it kind of OK. One other thing about my father – its ten years now almost - and yesterday, with a cold wind blowing on my face, as I was walking around the yard I realised that I had yet not been able to mourn him. You see, what happened to my father was the same day as my client, President Saddam Hussein, was executed. I was not able to save Saddam but had a good try in the District Court in the USA, but ultimately failed. I never cried for my father to date and how damned sad that is, but that is something very personal and when I’m in Italy I will, as I always do, go to the cemetery and put some flowers on my father’s tomb. But, those responsible for what happened will always be in my objective till the day I die.

01.10pm – Oh how I do wish that the media would leave Patricia Scotland alone. I mean the only real issue of the press is that she is black and so the press nitpicks into her life. For me she was and remains a great QC, brilliant lawyer, and suffered much prejudice at the bar solely because she was a black female, brilliant, barrister (BFBB). So please will my friends at the media leave her alone to get on with her job. Failing which lets look at the money spent at the Bar Council, or Law Society, or every Government Ministry on ‘unusual expenses.’ Leave her alone please.

01.16pm – On yet another front this place has finally joined the technology times: - people can now send money to those in jail online https://www.gov.uk/send-prisoner-money which private prisons did for the last ten years. Only now in HMPs caught up. Finally……

08.05am – As you can see the problems in the tail end of the criminal justice system are lack of staff and that is not acceptable:- in my manifesto for my political party in Italy (Partito Nazionale Italiano) but equally applicable to any country, I wrote that the mirror of the country is based upon the prison population.
 
 
Well no harm in my view in jailing even one million people, if the punishment fits the crime, but to do so you need a structure. The United States has four million people in prison and there is no question of lack of staff. So it must also be here too, and what the government seem to be doing is to talk tough (quite rightly) but cannot see through the punishment because of lack of staff. The other day at Alessandro’s graduation the Head of the Open University department covering prisons said that in the history of the OU no one who graduated from the OU in prison has since re-offended. What the hell does that tell you? It could not be simpler even for the Minister of Justice an unqualified person in the law – that education is the key to advancement. Imagine a country with no jails because no one committed crime!!!! It’s possible but you need to give the people the conditions to live in peace.

12.28pm – Well, well, well, its Nick Van Hoogstraten again and what a great comment: ‘When I get reincarnated I’m coming back as a lawyer.’ That sums up Nick. Nice to – see he is well. I do believe the High Court got it wrong, many years ago, in the civil suit but I did my job right when his conviction was quashed. Mr Justice Newman, the trial Judge, was wrong in law on joint enterprise and all that counts is that we won!!!!! Good luck to Nick. Don’t know about him being worth two billion pounds if you include all the land in Zimbabwe.
 
12.32pm -Tom Hendry has booked to see me. I mean he is 73 and still a great news editor and, a good and loyal friend. At least he has the guts not to be afraid of coming to see me. For that I will always be grateful.

08.57am – Well there you have it. The POA finally show their teeth and bite, and boy is it painful, but then sometimes to get better, requires going through the pain barrier. No Courts, no transfers, no hospital appointments, in fact no anything. Is it lawful? Maybe not but its happening and that shows how the law of times has no effect. Only those who comply with the law, does the law work!!!!!

07.32am – As I have been saying all along the whole HMP system is not fit for purpose and I will be taking my own legal action at what has become an intolerable situation. It is not the fault of the prison officers or certainly not the governor but directly of the government. Watch this space!!!! See the news article below?
 
 
I agree, but then as I said when Jeremy Wright was appointed Attorney General he was the first non QC to be Attorney General. With all the good will in the world Jeremy Wright is breakfast fodder for Lord Pannick QC, Rhodri Thompson QC, Dominic Chambers QC, Jessica Simon QC and a whole heap of other barristers! Do you know how many barristers were interested, including the AG? Twenty four counsels involved in R (Miller and Another) v Secretary of State for exiting the EU (2016) EWHC 2768 (admin) judgment, 3 November 2016!!!! Also, six firms of solicitors including two on legal aid. Now here is the bombshell!!!! – I will be added to the Supreme Court appeal as an intervener for reasons that will be published very soon. First I have to serve notice on Jeremy Wright QC, and AG, which by the time this gets to Caroline will be done.

12.36pm – Things do ‘seem’ to have settled down a bit regarding the industrial action of the prison officers.
 
12.37pm – Nice to see that Ava Gardiner’s apartment in London has been given an English Heritage Plaque.
 
 
If you read my autobiography, you will read how I went to Ennismore Gardens to be greeted by her and, her dog and, Portuguese butler. She was very nice to me.
 
12.39pm – I saw the news the other day – as I had expected – that Lauri Love would be extradited to the US.
 
 
I did tell Karen Todner that the climate was different now than a few years back and that Lauri would be extradited, but I was hoping to God that it would be suspended. His father is the Chaplain here and now that Donald Trump is the President-elect, it might well be worthwhile for Kaim Todner to write to Trump to issue a ‘Pardon.’ At the end of the day the problem is that medical condition is no bar to being jailed in the UK and US, and many other countries. Oh well…..

07.40am – Interesting comments from Charlie Falconer about Liz Truss. Look, OK she is not qualified neither was Michael Gove or Chris Grayling, but I believe Liz Truss has the right motivation. The man who destroyed the prison service and cause of all the problems was Chris Grayling. Blame anyone; it’s him an ex-supermarket shelf packer.
 
07.43am – I note that a High Court Judge has granted a deceased girl aged 14 the right to be frozen (cryogenics) so in the future when a cure occurs she can be revived. Brrr…frozen at -196c, and only possible in USA and Russia.

01.30pm – Well it does seem that the ‘army’ are the back up of the prison service. So I say this: - all those that are in prison for offences with a sentence of six years or less, and are under the age of 50, let them opt to serve with the military instead of prison, and for offences that do not include firearms. That would enhance the military, yet defray the prison population that would be substantially reduced. Even if you reduce the suggested six years down to three years, two years it would reduce the prison population.
 
01.33pm – Italy is at a crossroads with a referendum in December this year which I will also vote. Tomorrow I will go into a little detail.
 
01.41pm – Yesterday the Supreme Court granted Scotland and Wales the right to intervene in the so called ‘Brexit’ ruling. I will formally apply next week so we shall see what blows.

07.40am – It is nice to see Vojislav Seselj back in politics.
 
 
07.40am - I have known Voj since 1993, and I fiercely opposed his transfer to the Hague for alleged – nonexistent war crimes. I was so pleased when he was acquitted and I do hope he will be elected President. On that issue it is time that I also exhibited my colours and when I am in Italy my party Partito Nazionale Italiano will make the appropriate announcement. Watch this space. In 1995 I ran for the Italian Senate and had I accepted the then invitation from Silvio Berlusconi Forza Italia I would have been elected, but instead went for a local party and Biscordi was elected. This time it will be different!!!!! To those who know me, they know what I will do next within Italian politics.
 
 
07.47am – Now, I do not know all the particulars of the case of David Dearlove aged 70, but to be accused of a murder in 1968 is really quite incredible. If the evidence is there, then well done to the police, but if it’s only circumstantial, then at some stage this country should start to apply some new legislation regarding historical crimes – even murder, when only circumstantial evidence is available.

07.50am – Interesting to see that High Court Judges are themselves going to Court and suing the Ministry of Justice.
 
 
Let me say this:- any Court case, or hearing, or decision, that is now made by any of those six, must be seriously in question over fairness and potential bias. If you think that Lord Neubergers wife has tweeted anti-Brexit remarks and there are question marks over whether he can sit in the Supreme Court in the hearing on 5 December 2016!!!! Let’s see what happens. My own view – little greedy on the six judges. I’m surprised at Rabinder Singh especially as I know him. He was a brilliant defence QC but as a High Court Judge – well no comment and that says it all. 
 
 
07.54am – I do feel sorry for Oscar Pistorius. He is the product of a white establishment justice administered by black administration. What happened that night I don’t know, but how it was dealt with after serving a jail sentence, and then charged again is frankly appalling and wholly not fair. Good luck to Oscar.

12.44pm – I do really believe that Mat Renzi should reconsider his ‘throw toys out of pram’ attitude at resigning if the Referendum does not go his way. It is similar to what David Cameron did, and look at the results!!! Not good at all because despite all he was a much better Prime Minister than Theresa May.
 
 
12.46pm – Now, we come to my dear friend Berlusconi – all I can say is well done!!!! Do not ever allow anyone to black mail you into doing what you would not normally do. I certainly will never and I would follow the same steps as Silvio, but its best though if, in life, one can toe the line to avoid such potential problems. Watch this space about a Berlusconi comeback!!!!!

07.14am – Nice to see that Arran has not given up and continued his fight for justice. I acted for him at his last trial, which frankly was a travesty of justice, in that, the police clearly misconceived what had happened, and it was clear Arran was totally innocent, but they tried to take it to Court and he spent months in jail. So, good luck, and well done Arran, in not giving up your fight. The police got it wrong. Why the hell they don’t simply say so and say ‘sorry’ is beyond me and that is what spurs Arran forward. Well done!!!
 
07.18am – At my age my health is really strange, one day I feel fine, next day awful, but I just carry on regardless.

 07.43am – Well, let me tell you, that the above kind of ‘occurrence’ will cease when I go to Italy and the whole point of crime – the foundation of crime – is the desire of an individual to obtain something, that has not been paid for primarily, because the offender does not have the ability to pay for it. What Italy needs is to make sure that all citizens are made aware, and believe that they can achieve their dreams without taking short cuts, and crime is a short cut to attaining a dream. During the 1930s-40s the German people – all 50 million of them – believed that the Jews were responsible for all the bad in the World. That was a fallacy but imagine if Hitler had used his persuasive rhetoric to make citizens believe they could achieve their dreams by pure hard work!!! That is what I will bring to Italian politics.

06.06pm – Today is my daughter Anna-Meris birthday. I did call early and it was nice, now a mother herself, it’s good for a parent to see the end product. Being a parent is not easy at all.
 
Now, as you see, the subject is the referendum in Italy. You know what I truly believe??? :- people don’t give an eff about political reform – they want to be able to afford two meals a day, coffee, a sweet, being able to afford mortgage/rent and education for the children, petrol for the car, and now and then, a few nights out and annual holiday. Arrange that and anyone will be voted into power. So follow me…soon.

06.52pm – You know, I do so loath how some newspapers treat real stars of the screen, fancy accusing Sir Roger Moore of ‘fighting to remain in the public eye.’ I know Roger very well, and he actually shuns publicity, unless, it can be used for the right course and, remember, he is a UNICEF Ambassador and does great things for charity that the media have no idea. When it came to writing his autobiography he really did not want to do it and, when he did, he refused to tell some of the real truths in his life and about Hollywood, in case ‘it hurt people’ He was not worried about himself but of hurting the feelings of others. So please leave the man alone. He is fundamentally a good person.
 
06.56pm – My condolences to the family of Fidel Castro. I knew Mr. Castro and met him twice in Tenerife – on one occasion it was so secret a meeting, that my Consort (when she discovered I was there) thought the worst that I had probably or maybe gone to see someone else – I did – Fidel Castro and what a nice man even though we only really discussed bits of history and how close the world came to end in 1962!!!

09.37am – I would normally agree with Professor English, that a Judge who is not medically qualified should not make medical decisions, but a Judge dispenses the law (some say a Judge dispenses with the law) and that does not require a second qualification. Judges are often required to decide cases involving engineering disputes, computer and technology cases, patent law and, all that is required is for a Judge to be versed in the law. Now I do agree that a good few Judges know little of the law and its development, but others excel in their abundant knowledge and understanding of law, custom and statute. At the end of the day a Judge (man or woman) gives an opinion on the story being presented. No one is right or wrong – it’s all about presentation.
 
09.42am – I am amused that five months after the referendum to leave the EU, the Government have no idea in hell what will happen after they leave. Does it matter? Article 50 just says that a notice needs to be served saying a country wants to leave. There is no legal requirement to say how, or in what form, that departure should be. So why not just get on with it? I tell you why:- because Theresa May does not want to leave and thus the delay in the hope something turns up.

06.02pm – Well, when I saw the above in the Times about Bernie Squarcini known to us as ‘Bernie il Squartatore’ (Bernie the ripper) I had to laugh because John Sawer the ex head of SIS had his photo taken in a Speedo swimming costume, so I laughed in case ‘C’ was also spying for a competitor of Speedo!!! Had to laugh sorry. Today has been quite nice day, but this evening expected to be cold brrrrr, but not in my room because it’s nice and warm(ish)!!! All else is fine I guess. I had a nice letter from the Supreme Court about my application to intervene. Let’s see next week what blows. Tonight I shall relax a little as I have a feeling the next day, or so, may well bring some good news!!!!!

07.38am – When I saw the news article above, well I thought to myself ‘who the hell wants so many cars?’ Well my client – sadly now deceased – John Goldfinger Palmer had a similar amount of cars in Tenerife, probably even more than the one Italian businessman. I wonder if someone could email me and let me know the result of the auction. It is interesting to note that the cars were ‘seized’ but it does not say by whom or, why or, on what basis. I guess it must be the gilded Guardia oh Finanza (Financial Police) who have more powers than is good for them. Not much different from Her Majesties Revenue and Customs. Well, there is a surprise that some parts of the UK administration, is in line with its European counterparts.
 
07.44pm – This Sunday will determine the future (short term) of Italy but don’t hold your breath. As I said the person who will govern Italy is the person who can offer (and deliver) to the people two meals a day, petrol for car, money for alcohol and cigarettes and a living wage. Watch this space!!!!

12.42pm – The news report above shows just how medicine and the law do not always mix. Women, for one reason or another, want to look their best and feel their best. If you read the book The Godfather by Mario Puzo (it was not in the film version) Santonios’ lover Connie, I think her name, had her vagina tightened by a plastic surgeon and that was in the 1930s set. So, with the FGM Act 2003 can, or more important, should a surgeon be prosecuted for carrying out plastic surgery on a woman’s private (in some cases not so private) parts? It’s an interesting question that I’m not so decided upon. However, should a fourteen year old girl be given a false hope that by freezing her body she will or can be thawed in the future and cured of any diseases???? Going back to the Godfather I wonder why Coppola did not add that part to the film about Santinos’ lover??? I have met Francis Ford Coppola in San Francisco, but in the event I get to meet him again I really must ask him!!!!!
